Terms of Service For Commissioned Custom Work

1. Custom Commission Process

All banners are hand-painted/custom-made to order. By placing an order, the Client agrees to provide clear instructions and feedback. The Artist reserves the right to decline any commission request that involves copyrighted material or content deemed inappropriate.

2. Proofing & Approval (For Commissioned Custom Work) 

A digital or sketched proof will be provided for review. The Client is responsible for checking all spelling, dates, colors, and design elements. Once the Client provides final approval, the design is locked. No changes can be made after this point, as painting will begin immediately. 

3. Payments & Cancellations 

  • Payment: Full payment is required before the painting process begins. 

  • Cancellations: Orders may be canceled for a full refund only before the proof has been created. Once a proof is provided, a "design fee of $15 is non-refundable if order is canceled. 

4. Intellectual Property

The Artist retains all rights to the original artwork and design. The Client is granted ownership of the physical banner for personal use. The Artist reserves the right to display photos of the finished banner for promotional purposes (social media, website, portfolio).

5. Shipping & Delivery

The Artist is not responsible for delays caused by the shipping carrier, customs, or incorrect addresses provided by the Client.

  • Damage: If a banner arrives damaged, the Client must notify the Artist within 48 hours with photos of the damage. A replacement of the same design will be issued at no cost.

6. Limitation of Liability

The Artist’s total liability to the Client is limited to the amount paid for the product. The Artist is not responsible for any indirect or consequential damages resulting from the use of the product.

Terms of Service: For our off the shelf non-commissioned items.

1. Product Availability & Descriptions

We strive to be as accurate as possible with our colors, textures, and descriptions.

  • Handmade Variance: For hand-painted or artisan items (e.g., banners, signs, or poured candles), please account for slight variations. These are not "defects" but the mark of a handmade product.

  • Monitor Settings: We cannot guarantee that your device’s display of any color will be 100% accurate.

2. Shipping & Delivery

  • Processing Time: Standard "off-the-shelf" orders are processed within [1–3] business days.

  • Shipping Liability: Once a package is handed to the carrier (USPS, UPS, etc.), Poppie & Pine Studio is no longer responsible for delays, lost packages, or theft. We recommend shipping to a secure location.

  • Incorrect Address: If a package is returned to us due to an incorrect address provided by the customer, the customer is responsible for the cost of re-shipping.

3. Returns & Exchanges

We want you to be happy with your purchase!

  • Standard Items: Returns are accepted within 30 days of delivery.

  • Condition: Items must be in their original, unused, and unwashed condition. Candles must be unlit; stationery must be unmarked; apparel must have tags attached.

  • Non-Returnable: Sale items, digital downloads, and "Final Sale" clearance items are not eligible for return.

  • Return Shipping: Unless the item arrived damaged, the customer is responsible for return shipping costs.

4. Damages & Claims

If your order arrives damaged, please contact us at poppiepinestudio@gmail.com within 48 hours of delivery.

  • You must include photos of the damaged item and the original packaging.

  • We will issue a replacement or a full refund for items proven to be damaged during transit.

5. Cancellations

  • The "Quick-Change" Window: You may cancel a regular order for a full refund within 12 hours of purchase, provided it has not yet shipped.

  • Once an order is marked as "Shipped" and a tracking number is generated, it cannot be canceled and must be handled as a return.

6. Safety & Proper Use

By purchasing, you agree to use all products (especially candles and home decor) for their intended purposes. Poppie & Pine Studio is not liable for any injury, loss, or damage resulting from the misuse of our products or failure to follow safety instructions (e.g., leaving candles unattended).
